Chrysler has blinked!! Earlier today, Chrysler announced that it was
initiating a "repair compaign" with respect to the Bendix 10 ABS systems. In
particular, they will send notices to all 350,000 owners that "enhanced
diagnostic test equipment" is available to test the brakes and that (1) CC
will inspect any vehicle in which the owner suspects a problem; (2) will
replace malfunctioning ABS parts free of charge; (3) will reimburse owners
for all prior costs; and (4) will extend the warranty to 100,000 miles on the
ABS.
This is a major concession by Chrysler, even if there are some problems --
including the fact that the brakes will apparently be repaired by the same
defective systems. However, getting an actual "recall," especially if a
corrected system cannot be identified, might be hard to get. We are
nonetheless going to continue to push for better results. I also am quite
convinced that our amended complaint affected the decision to do the
repairs. The press release specifically admits that the leak is occuring in
the cars, leading to a loss of power assisted braking -- which is precisely
what the complaint alleged. CC will, of course, argue that we had nothing to
do with their action and thereby argue that we are not entitled to any
attorneys' fees. We will see.
